Privacy Notice

1. Who we are

This Privacy Notice describes how Apex Automated LLC (“we”, “us”, “our”) — the company behind PicPostly — collects, uses, shares, and protects personal data. For data we collect about you in the course of providing the Service, we act as the data controller.

2. Data we collect

  • Account data: name, email, password hash, display name, default location.
  • Listing content: photos you upload, item details, generated drafts.
  • Usage data: pages visited, features used, listing counts, error logs.
  • Device data: IP address, browser, operating system, device identifiers.
  • Support data: messages you send to us and our replies.
  • Order data: a record that you purchased a subscription, plan tier, and renewal status. Payment card and billing details are collected by Paddle, not us.

3. How we use your data

  • To create your account and provide the Service (legal basis: contract).
  • To generate listing drafts from your photos and inputs (contract).
  • To operate and improve the Service, debug issues, and prevent abuse (legitimate interests).
  • To communicate with you about your account, security, and updates (contract / legal obligation).
  • To send marketing emails where you have opted in or where permitted by law (consent / legitimate interests). You can unsubscribe at any time.
  • To comply with legal obligations and respond to lawful requests (legal obligation).

4. AI processing

Photos and inputs you submit are sent to our AI providers strictly to generate your listing drafts. We do not use your inputs or outputs to train third-party AI models without your consent.

5. Who we share data with

  • Service providers / subprocessors: hosting, database, file storage, email, analytics, AI inference, and customer support tooling. They process data on our behalf under contract.
  • Paddle.com Inc. and affiliates — our Merchant of Record — for sale of subscriptions, payment processing, subscription management, tax compliance, invoicing, and refund handling.
  • Professional advisers such as legal, accounting, and insurance advisers when needed.
  • Authorities where required by law, court order, or to protect rights, safety, and security.
  • Successors in connection with a merger, acquisition, or sale of assets, subject to this Notice.

6. International transfers

We and our service providers may process data outside your country, including outside the UK and EEA. Where required, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses or adequacy decisions.

7. How long we keep data

We keep account and listing data for as long as your account is active. After you delete your account, we delete or anonymise your data within a reasonable period, except where we need to retain it to comply with law, resolve disputes, or enforce agreements (for example, transaction records for tax purposes).

8. Your rights

Depending on where you live, you may have rights to access, rectify, erase, restrict, or object to processing of your personal data, to data portability, and to withdraw consent at any time. Users in the UK/EEA also have the right to lodge a complaint with their supervisory authority. We respond to verified requests within one month.

9. Security

We use appropriate technical and organisational measures to protect personal data, including encryption in transit, access controls, and monitoring. No system is perfectly secure; please use a strong, unique password and notify us if you suspect unauthorised access.

10. Cookies

We use strictly necessary cookies to keep you signed in and to operate the Service. We may also use limited analytics cookies to understand usage. You can control cookies via your browser settings; disabling essential cookies may break the Service.

11. Children

The Service is not directed to children under 13 (or the minimum age in your country). We do not knowingly collect data from children. If you believe a child has provided us with data, contact us and we will delete it.

12. Changes to this Notice

We may update this Notice from time to time. Material changes will be communicated through the Service or by email.
